Terms of Service

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY ACCESSING OR USING FLOODLINE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE SERVICE.

1. Definitions

"FloodLine," "we," "us," or "our" refers to FloodLine, operated at floodline.org. "Service" means the FloodLine website, mobile applications, APIs, and all related tools, features, and functionality. "User," "you," or "your" refers to any individual or entity accessing or using the Service. "Customer" means a homeowner or property manager seeking plumbing services through FloodLine. "Plumber" or "Service Provider" means a licensed plumbing professional or company registered on the platform. "Lead" means a customer inquiry or service request routed to one or more Plumbers through the Service. "Content" means any text, images, reviews, data, or other materials submitted to or displayed through the Service.

2. Nature of the Service

FloodLine is a technology platform that operates as a directory and lead generation service connecting Customers with licensed plumbing professionals. FloodLine does not provide plumbing services, employ plumbers, or act as a contractor, subcontractor, or agent of any Plumber listed on the platform. We are an independent intermediary. All service agreements, warranties, and obligations related to plumbing work are solely between the Customer and the Plumber. FloodLine makes no representations or warranties regarding the quality, safety, legality, or suitability of any plumbing services obtained through the platform.

3. Eligibility and Account Registration

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use the Service. By creating an account, you represent and warrant that all information provided is accurate, current, and complete, and you agree to update such information to maintain its accuracy. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify FloodLine immediately of any unauthorized use of your account. FloodLine reserves the right to suspend or terminate any account at any time, with or without cause or notice.

4. Plumber Obligations

By registering as a Plumber on FloodLine, you represent, warrant, and covenant that:

  • You hold all licenses, permits, and certifications required by federal, state, and local law to perform plumbing services in every jurisdiction where you accept Leads.
  • You maintain commercial general liability insurance with a minimum coverage of $1,000,000 per occurrence and workers' compensation insurance as required by law.
  • You will respond to emergency Leads within the response time advertised on your profile, and within a maximum of 2 hours for all other Leads.
  • You will provide honest, transparent, and competitive pricing to Customers. Bait-and-switch tactics, price gouging, or materially misleading quotes are strictly prohibited and grounds for immediate termination.
  • You will perform all work in a professional, workmanlike manner in accordance with applicable building codes, industry standards, and manufacturer specifications.
  • You will maintain accurate and current profile information, including service areas, certifications, and business hours.
  • You will not solicit Customers obtained through FloodLine to bypass the platform for future services during the first 12 months after the initial Lead.

Failure to comply with any of these obligations may result in profile suspension, termination, forfeiture of subscription fees, and removal of all reviews and listing data.

5. Subscription Plans, Fees, and Payment

5.1 Subscription Tiers. FloodLine offers tiered subscription plans (Starter, Pro, and Elite) with varying Lead allocations, features, and pricing as described on our pricing page. Plan details, including pricing, may be modified by FloodLine at any time with 30 days' written notice.

5.2 Billing Cycle. Subscriptions are billed monthly in advance on the date of initial enrollment. All fees are quoted and payable in U.S. dollars.

5.3 Automatic Renewal. Subscriptions automatically renew at the end of each billing cycle unless canceled at least 48 hours before the renewal date. You authorize FloodLine to charge your payment method on file for each renewal period.

5.4 Overage Charges. If you exceed the Lead allocation included in your subscription plan, additional Leads will be charged at the per-Lead overage rate specified for your tier. Overage charges are billed at the end of each billing cycle.

5.5 Refund Policy. All subscription fees are non-refundable once the billing period has begun. Partial-month refunds are not available upon cancellation. Overage charges for Leads already delivered are non-refundable. FloodLine may, in its sole discretion, issue credits for Leads that are demonstrably fraudulent, duplicate, or materially defective.

5.6 Failed Payments. If a payment fails, FloodLine will attempt to charge the payment method on file up to three additional times over a 10-day period. If all attempts fail, the account will be suspended, and the Plumber's profile will be hidden from search results until the balance is resolved.

5.7 Taxes. All fees are exclusive of applicable taxes. You are responsible for all sales, use, value-added, and other taxes imposed by any governmental authority on the transactions contemplated by these Terms.

6. Customer Acknowledgments

By submitting a Lead or using the Service, Customers acknowledge and agree that:

  • FloodLine is a lead generation and directory platform, not a plumbing contractor. We do not guarantee the availability, quality, or pricing of any Plumber.
  • Contact information you provide (name, phone, email, address) will be shared with one or more Plumbers in your area for the purpose of responding to your service request.
  • You may be contacted by multiple Plumbers in response to a single Lead submission.
  • Any agreement for plumbing services is between you and the Plumber. FloodLine is not a party to such agreements and bears no responsibility for the outcome.
  • You should independently verify the credentials, licensing, and insurance of any Plumber before authorizing work.
  • Emergency plumbing situations may involve risks to health and property. FloodLine is not responsible for any injury, damage, or loss arising from plumbing emergencies or the response thereto.

7. FloodLine Verified Guarantee

7.1 Coverage. The FloodLine Verified Guarantee is an optional, per-job protection plan available to Customers for a fee of $4.99 per job. When purchased, FloodLine verifies that the matched Plumber holds valid licensing and insurance at the time of the match and will mediate disputes related to the covered job.

7.2 What Is Covered. The Guarantee covers: (a) verification that the Plumber is licensed and insured at the time of matching; (b) FloodLine-facilitated dispute mediation between Customer and Plumber for the specific job; (c) a 90-day workmanship guarantee on the covered job, enforceable by FloodLine through the Plumber.

7.3 What Is NOT Covered. The Guarantee does not cover: (a) property damage, personal injury, or consequential damages of any kind; (b) work performed outside the scope of the original Lead; (c) pre-existing conditions or code violations; (d) failure to follow Plumber maintenance instructions; (e) acts of God, vandalism, or negligence by the Customer; (f) disputes initiated more than 90 days after the work was completed.

7.4 Limitation. The Verified Guarantee is not an insurance policy, warranty, or surety bond. FloodLine's maximum aggregate liability under the Verified Guarantee for any single job shall not exceed the amount paid by the Customer for that specific Guarantee purchase ($4.99). The Guarantee does not create any employer-employee, principal-agent, or joint venture relationship between FloodLine and any Plumber.

8. AI Instant Quote Tool

The FloodLine Instant Quote Tool provides estimated cost ranges only. These estimates are generated algorithmically based on general industry pricing data and do not constitute a binding quote, bid, or offer from any Plumber or from FloodLine. Actual costs may vary significantly based on the specific conditions encountered, parts required, labor rates in your area, time of service, and other factors. FloodLine makes no representation or warranty regarding the accuracy of cost estimates. By using the Instant Quote Tool, you agree that FloodLine shall have no liability for any discrepancy between the estimated and actual cost of services.

9. Reviews and User Content

9.1 Customer Reviews. Customers may submit reviews of Plumbers. By submitting a review, you represent that your review is truthful, based on your genuine experience, and does not contain defamatory, obscene, or unlawful content. FloodLine reserves the right to remove, edit, or decline to publish any review at its sole discretion.

9.2 License Grant. By submitting Content to FloodLine, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, display, distribute, and create derivative works from such Content in connection with operating and promoting the Service.

9.3 Prohibited Content. You may not submit Content that: infringes intellectual property rights; contains malware or harmful code; constitutes spam, phishing, or unsolicited advertising; impersonates any person or entity; or violates any applicable law.

10. Intellectual Property

The Service, including all software, designs, text, graphics, logos, trademarks, trade dress, and other intellectual property displayed on or through FloodLine, is owned by or licensed to FloodLine and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, decompile, reverse engineer, or otherwise exploit any portion of the Service without prior written consent from FloodLine. The FloodLine name, logo, and all related marks are trademarks of FloodLine. Unauthorized use of any FloodLine trademark is strictly prohibited.

11. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Submit false, misleading, or fraudulent information, including fake reviews, fictitious Leads, or inaccurate profile information.
  • Scrape, harvest, crawl, or use automated means to access the Service or extract data without prior written consent.
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Service, its servers, or connected networks.
  • Circumvent, disable, or tamper with any security features of the Service.
  • Use the Service to send unsolicited communications or spam.
  • Attempt to decompile, reverse engineer, or derive the source code of any software used in the Service.
  • Use the Service in any manner that could damage, disable, or impair the Service or interfere with other users' access.
  • Engage in price fixing, bid rigging, or other anticompetitive practices through the platform.

12. Indemnification

You agree to indemnify, defend, and hold harmless FloodLine, its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; (d) any Content you submit to the Service; (e) for Plumbers, any plumbing services you provide to Customers obtained through the Service; (f) any dispute between a Customer and a Plumber. This indemnification obligation shall survive the termination of your account and these Terms.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. FLOODLINE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. FLOODLINE MAKES NO WARRANTY REGARDING THE QUALITY, ACCURACY, RELIABILITY, TIMELINESS, OR COMPLETENESS OF ANY INFORMATION, CONTENT, OR SERVICE PROVIDED THROUGH THE PLATFORM. FLOODLINE DOES NOT ENDORSE, WARRANT, OR GUARANTEE ANY PLUMBER LISTED ON THE PLATFORM, AND MAKES NO REPRESENTATIONS REGARDING THE SKILL, QUALIFICATIONS, LICENSING STATUS, INSURANCE COVERAGE, OR RELIABILITY OF ANY PLUMBER. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FLOODLINE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER FLOODLINE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL FLOODLINE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO FLOODLINE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100.00). THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION IN THE AGGREGATE, INCLUDING BUT NOT LIMITED TO BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL OR EQUITABLE THEORY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

15. Dispute Resolution and Arbitration

15.1 Informal Resolution. Before initiating any formal dispute resolution proceeding, you agree to first contact FloodLine at legal@floodline.org and attempt to resolve the dispute informally for at least 30 days.

15.2 Binding Arbitration. If the dispute cannot be resolved informally, you and FloodLine agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively through binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator in Bexar County, Texas. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

15.3 Class Action Waiver. YOU AND FLOODLINE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and FloodLine agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

15.4 Exceptions. Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Bexar County, Texas, and you consent to the personal jurisdiction of such courts.

17. Termination

17.1 By You. You may cancel your account at any time through the dashboard or by contacting legal@floodline.org. Cancellation takes effect at the end of the current billing period. You remain liable for all charges incurred prior to cancellation, including overage charges.

17.2 By FloodLine. FloodLine reserves the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including but not limited to: violation of these Terms; fraudulent activity; failure to pay fees; receipt of complaints from Customers; failure to maintain required licensing or insurance; or conduct that FloodLine determines, in its sole discretion, is harmful to the platform, other Users, or third parties.

17.3 Effect of Termination. Upon termination, your right to access the Service ceases immediately. Sections 9.2 (License Grant), 12 (Indemnification), 13 (Disclaimer), 14 (Limitation of Liability), 15 (Dispute Resolution), and 16 (Governing Law) shall survive termination.

18. Modifications to Terms

FloodLine reserves the right to modify these Terms at any time. Material changes will be communicated by posting the revised Terms on the Service and updating the "Last Updated" date. For Plumbers with active subscriptions, material changes will also be communicated via email at least 30 days prior to taking effect. Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, your sole remedy is to discontinue use of the Service and cancel your account.

19. General Provisions

19.1 Entire Agreement. These Terms, together with the Privacy Policy and any applicable subscription agreement, constitute the entire agreement between you and FloodLine and supersede all prior agreements, representations, and understandings.

19.2 Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

19.3 Waiver. The failure of FloodLine to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

19.4 Assignment. You may not assign or transfer these Terms or any rights hereunder without FloodLine's prior written consent. FloodLine may assign these Terms without restriction.

19.5 Force Majeure. FloodLine shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to natural disasters, pandemics, government actions, power failures, internet disruptions, or acts of terrorism.

19.6 Notices. All notices to FloodLine must be sent to legal@floodline.org. Notices to you will be sent to the email address associated with your account.
